What is the legaity of mushroom spores?

hey, first of all i wanna say you guys have a great site, good job. the reason i'm e-mailing you though is I found a web site that is supposed to sell spore prints of what i think is the mushroom Psilocybe Cubensis (it says P. Cubensis, can you think of anything else it might be?) I am pretty sure that kind of mushroom is illegal, otherwise i wouldnt hesitate to buy it. Can you email me with any info you have on the legality of Psilocybe Cubensis,, i would appreciate it. thank you |

Whereas psilocybin-containing mushrooms (Psilocybe, Paneoulus, etc) are illegal to grow, possess and sell because they contain psilocybin , it is not federally illegal to sell or posess the spores of these mushrooms. However, the second you germinate the spores and have a mycelium, you are comitting an illegal act because the mycelium contains psilocybin.
Some states, such as California, do specifically list the mushrooms and their spores in their controlled substance laws and therefore, in those states, psilocybin mushroom spores are illegal to possess, sell, or trade without proper licenses.
