Amanita muscaria (as well as all other Amanita species) is uncontrolled federally in the United States. This means all parts of the plant and its extracts are legal to cultivate, buy, possess, and distribute (sell, trade or give) without a license or prescription. If sold as a supplement, sales must conform to U.S. supplement laws. If sold for consumption as a food or drug, sales are regulated by the FDA.
U.S. STATE LAW #
Louisiana #
Effective Aug 8, 2005 (signed into law Jun 28, 2005) Louisiana Act No 159 makes 40 plants illegal, including Amanita muscaria, when intended for human consumption. The law specifically excludes the "possession, planting, cultivation, growing, or harvesting" of these plants if used "strictly for aesthetic, landscaping, or decorative purposes." Tennessee #
Tennessee did not pass the proposed bill that would have banned dozens of plants as "hallucinogenic" when intended for human consumption. Instead, they banned only Salvia divinorum. See Comments on New State Laws Controlling the Consumption of Hallucinogenic Plants.

INTERNATIONAL LAW #
Psychoactive Amanitas are not listed in most drug laws because of their low incidence of recreational use. Psychoactive Amanitas and their active chemicals are not listed in the United Nations Drug Control treaties.
Australia #
A. muscaria is somewhat controlled for importation (requires listing on forms if an active ingredient in an imported supplement or herbal preparation - 1990 no 394 "therapeutic goods regulations"). Muscimol may be a controlled substance in Australia, or it may have only been in a proposed bill, we can't tell. (unconfirmed)

Japan #
Despite the 2002 scheduling of psilocybes in Japan, A. muscaria are still legal and sold openly at smart shops.
Mexico #
